1446 EDMONTON DAILY DEC 17, 1907 CONROY, H.A. WILLIAMS, E.B. ROBERTS, Ernest C. CORNWALL, J.K. At the Supreme Court yesterday afternoon the case of J.K. Cornwall, Lesser Slave Lake, vs. The National Trust Company, an action for $1,200, the face of a cheque issued by him, came up for hearing. The National Trust Company are the executors of the late Ernest C. Roberts, a former partner of Mr. Cornwall in the northern fur trade, who died some time ago. Shortly after his death H.A. Conroy, Ottawa, who pays the Indian treaty money, presented to Mr. Cornwall a cheque signed by the deceased for $1,200 for money alleged to have been loaned him, and the cheque Mr. Cornwall paid, believing that it would later be made good. He afterwards secured from Mr. Comroy what purported to be an assignment of the debt, drawn up at Sort Cross & Biggar's office and witnessed by Mr. E.B. Williams of that firm. This however Mr. Conroy repudiated, claiming that he had signed nothing except the endorsement of the cheque that he had received from Roberts. The chief Justice, in giving judgement held that the assignment was valid and gave judgement for the plaintiff for the full amount of $1,200. O.M. Biggar, for the plaintiff, JAMES D. Hyndman for the defendant. The jury, after an hour and a half's deliberation brought in a verdict for Frank Goode for $100 and costs in the Goode vs, The Journal liable case. J.R. Boyle for the plaintiff G.B. O'Connor for the defendant.
